A trademark registration is only effective in the country in which you file the trademark. regional protection can be applied for under the terms of the CTM (Community Trademark) system, to cover the countries of the European Union and under the Madrid Protocol to cover a series of countries across the world. South Africa intends to join the Madrid Protocol, but is currently not able to because of the excessive time CIPC takes to register marks.
A South African application can serve as a basis for your claiming convention priority in respect of corresponding applications in other countries, providing such foreign applications are filed within six months of the South African application.
